A sentencing hearing for a Brighton man who pleaded guilty to stealing a drag racer was delayed Thursday after the judge told the defense he would not follow the plea agreement.
Hans Adam Geise, 27, pleaded guilty as charged in Livingston County Circuit Court to receiving and concealing a stolen vehicle for taking a cherry 1991 Ford Mustang from Varsity Ford dealership in Ann Arbor on Aug. 28 in exchange for prosecutors recommending that he serve no more than two years on the minimum sentence.
However, Judge David Reader said he was going to exceed that recommendation because Geise committed new crimes a mere three weeks after entering a plea in the case. What the judge wanted was not made public in court.
In the new case, Geise has pleaded guilty and is awaiting sentencing in Washtenaw County on charges he stole trailers in that area.
Defense attorney Carolyn Henry accepted Reader's offer to submit a written memorandum in which she can try to convince the judge to follow the sentencing agreement.
Geise was charged after a Brighton police officer spotted the vehicle — which is street-legal, but is modified to suit racing needs — at a car wash.
The officer checked on the license plate and discovered it belonged on a Jeep.
The officer then checked the vehicle identification number and discovered it had been reported stolen from Ann Arbor.
Geise, who entered his plea as a habitual offender, also pleaded guilty to receiving and concealing stolen property valued at least $1,000 but less than $20,000 for taking a vehicle trailer.
His criminal history includes convictions for receiving and concealing stolen property, larceny and felonious assault.
Henry said her client's behavior was "clouded by substance" abuse. while Assistant Prosecutor Pamela Maas said Geise's behavior was "very brazen" considering he committed new crimes.
"We can't change him ... but we can protect future victims," Maas said.
