Problems with a shady shop

I don't care if it was verbal. I've gone to state meetings on the matter. It *HAS* to be done on a WRITTEN estimate AND there HAS to be a customer signature. Verbal authorizations do NOT hold up with state laws for initial estimates/diagnostic fees.

If anyone wants, I have the paperwork and can share with them the laws.

There are some pretty important things there. I may even have the email address still of one of the lead investigators for the state.... But yes, legally, they CANNOT charge her for something that they did NOT have in writing. Also, in this shop, find out if their state licenses are posted in visible location, as well as their mechanics licenses, and their state req'd signage. You can reign down a hell storm of fines upon them from the state inspectors....
 
So here is the story....

My neighbor friend has a buick lesabre with some problems. She wanted to take up to a local shit hole shop to have them take a look at it to see what was wrong with the front suspension. She was planning on having them tell her whats wrong and then have a mechanic (myself) actually do the work. SHe took the car in and said "hey can you look at my car blah blah blah" they said ok sure we will call you. No mention of having to pay a fee to look at it and nothing listed in the store on a sign or anything.

SHe went to go pick the car up and they said well that will be 50 dollars. SHe declined and said that there were no previous agreements on charges or anything like that. Now they wont give the keys back until she pays. She is already working on borrowed money.

What is the legality of this? Could she call the police and say that they have her car and wont give her the keys back or what? Technically if there was no preauthorizeation for any charges they cant do anything but be pricks.

I was going to offer her to use a couple of my free AAA tow miles and just have the car towed out of the place at night but then they would still have the keys lol...yes/no?
Nobody works for free, why should the shop although they should have been up front about it, we always charged a fee to inspect but if you had the work done by us the fee was waved. Big diferance from doing it in your garage to paying employees, insurance ect ect!

Wow... wtf is wrong with people. Taking your car into a shop knowing that you aren't going to have them perform any work on the car AND EXPECTING TO NOT HAVE TO PAY ANYTHING FOR THERE TIME! Not even enough sense to ask if there will be a check out fee, just expected it to be free. WOW

What next, walk into to a doctors office and get a diagnosis and EXPECT to not pay and then bitch if they want to charge you?
 
Some shops will give a free inspection on underbody stuff/brakes. (pretty easy to diag)

You being the mechanic should have been able to diag the car, and fix it... Not sure why it was even taken to the shop to waste their time?

A shop in the end is still a business and the guys who work in it want paid @ the end of the week. They should have gave an estimate up front if they didnt but nodody including yourself wants to start a job only to have someone else get paid on it.

Thanks for all the lovely info guys im going to print out these documents and this forum and look at it with her and see where to go from here. I know its 50 dollars but I dont have time for shady ass bullshitting shops that fuck with people mostly girls.
If they didnt tell her upfront it was wrong but calling them shady when your entire trip there was shady having no intention on actually using them. Everything at a shop can be done cheaper in someones backyard buying internet parts but if everyone keeps this idea going the brick and mortar shops and stores will all eventually go under leaving you without the service you never wanted to pay for but like about them.People always want the parts ready now like a retail store and the warranty of a retail store but never want o pay the retail price it takes to keep that store open. The same goes for service......... everybody always want the professional advice but nobody wants to pay for it.Real businesses have overhead(I run one)and It cost us roughly $200 a day to just open the doors before payroll. If it was something you could have figured out in minutes and were gone she should have waited instead of wasting another mans valuable time afterall you couldnt have done the job untill you were back anyway............. to sum it up pay the guy, he did the job and its not an absurd price.

By state law, the shop can charge 20 dollars (this amount was set in the 1970's, and had never been adjusted for inflation) with no verbal or written permission given. They can also charge 10 dollars per day for storage (this amount was updated in the last year-most shops were charging higher amounts)
Most repair facilities do not just let anyone drop off their vehicle without some written documentation given to the vehicles owner (hold harmless clauses, theft, fire, damages and permission to inspect & road test your vehicle). If they do, their setting themmselves up for losses. Most facilitys have written fees and terms listed on their work orders and their office walls and waiting rooms.
I suggest she read her paper work carefully. Im also certain the fee is waived if she approves the work (this is to weed out scamming customers, like her)
You admitted she only went there only to scam them, and now she has to pay a fee, and she (and you) are complaining....over 50 bucks. Wow.
I say pay the bill, be thankful they did your job for you, and buy the parts and install them.
You (or her) would not like it if someone did the same thing to you at your work.
Treat people like you would want to be treated....always.
 
Sorry Gearbox - your storage rules are incorrect. Storage can ONLY be charged if the customer is made aware of it OR it is posted in a PUBLIC location where the customer can see it when they come inside. If you'd like I can point you in the direction of state enforcement on the matter.

There are many rules that people SAY are law that are not..

257.1332 Written estimate required; consent to excess charge; payment of actual cost if cost
less than estimate; cost of returning vehicle to original condition; cost of diagnosis;
waiver of rights.
Sec. 32. (1) A motor vehicle repair facility shall give to the customer a written estimate, itemizing as
closely as possible the price for labor and parts necessary for a specific job prior to the commencement of
work.
A facility shall not charge for work done or parts supplied in excess of the estimated price or in excess
of the limit stated by the customer in the waiver provided for in subsection (3) without the knowing written or
oral consent of the customer which shall be obtained at some time after it is determined that the estimated
price or stated limit is insufficient and before any work not estimated or in excess of the limit is done or the
parts not estimated or in excess of the limit are supplied. If a waiver is not signed as provided in subsection
(3) and the estimated price is exceeded by not more than 10% or $10.00 whichever is lesser, the written or
oral consent of the customer for the excess charge need not be obtained unless specifically requested by the
customer.
This section shall not be construed as requiring a motor vehicle repair facility, mechanic, or
mechanic trainee to give a written estimated price if he agrees not to perform the requested repair. If the
actual cost of repair is less than the agreed upon estimated cost, the customer shall pay only the actual cost.
(2) If the facility or mechanic informs the customer that the price for repair will exceed the written estimate
or the stated limit in the waiver and the customer does not want the repair work performed then the customer
is liable for all reasonable costs to return the vehicle to the condition it was when it entered the facility. These
costs should be indicated in written form itemizing the costs as closely as possible with a copy given to the
customer. The cost of a diagnosis to be made, whether or not the customer authorizes repairs to be performed,
shall be contained in the written estimate before the diagnosis is undertaken.

(3) If a customer initiates a request for service or parts for the repair of a motor vehicle without receiving a
written estimate and voluntarily agrees to pay all reasonable costs of repair up to an amount stated by the
customer, a repair facility may obtain from the customer a waiver of his right to receive a prior estimate of
repair costs.
The waiver shall be in 14 point or larger bold capital type face and executed with 1 copy to the
customer requesting the repairs and shall read as follows:
“I, __________, voluntarily request __________ to provide services or parts in the repair of the below
described motor vehicle without receiving an estimate of repair costs. By signing this form, I understand that I
will give up my right to:
1. Receive a written estimate of the cost for repairs;
2. Approve in advance any repairs or costs with a total cost under $ __________; and
3. Refuse to pay for repairs with a total cost less than the amount stated above.
The facility may exceed the amount stated above only after I give my written or oral approval.
Motor vehicle description:
Customer signature _______________
Date __________
Time __________”
This waiver shall not be effective unless given by the customer voluntarily and with full knowledge of the
implications of the waiver. A motor vehicle repair facility or anyone in its employ shall not make use of the
waiver in an attempt to evade this act.

I agree 100% with this. Being a full commission sales person (not much different than a tech working on flat rate) that shit pisses me off. A flash of a smile from a chick ain't paying my bills, pay them for diagnosing what you are going to fix. Now if it was a friend or a favor, I could understand them doing it for free. If she was just some chick off the street, PAY UP SUCKER! :)

You don't need to preach to me about auto repairs laws. I know them inside and out. As I said, It probably posted in their waiting room, and on their invoice.
I know they are on my walls, both in my offices and in my shop and on my estimates of repairs AND ON MY PERMISSION TO INSPECT VEHICLE WAIVERS, WHICH I MAKE EVERYONE SIGN AND GIVE A COPY TO-NO EXCEPTIONS Even if vehicles are dropped off over night, before I touch it they get a email decribing in detail my terms, and I demand a email back, agreeing to the terms.

And, they need no written permission to charge 20 bucks for basic inspection

Ive been by that shop many of times. They block the entrances/exits when they are closed. Im positive they are not "new" to auto repair, and theirs a reason the lot is blocked at night. Im willing to bet they know their rights all too well.

They wanted 1200 bucks to replace front strut assemblies (quick struts) and lower balljoints on a a 1997 buick lesabre. Ill do it for her for 300 parts on rockauto and 200 labor.

And I think sidewayscoupe was talking about checking out the chicks undercarriage and not the vehicles undercarriage. (Although I may be mistaken)
 
If you couldn't diagnose the problem you shouldn't try to fix the problem....


Pay the $50.00 for being shady
 
do you lik to work for free?? didnt think so, so what makes you think a REAL tech wants to look at peoples junk ass cars for free?? and if your a "mechanic" why couldnt you diagnose it yourself?? back yard hack thats why.
 
Great topic, even better discussion. And for the independent shops a big issue. Like was stated, cost money to open the doors, cost money to bring the car in and costs even more to put seat/floor covering in car, raise it on hoist and diagnose issue. Most flat rate schedules don't list diagnosis time. I'm of the opinion that some of the state rules need to be adjusted/modified as they are out of date in my mind.

There are also a number of situations like the OP's, wasting good tech/shops time with no intention of ever having work done. Especially with more people trying to hang on to their vehicles.
