Girlfriends 1st offense DUI in Novi- what may happen

What may happen? Well, besides all of what the other guys have posted, she'd be looking for a new boyfriend if she was my girl.. That's terribly irresponsible and there's no excuse for it. I would trust my GF to make better decisions than that. If not, see ya!!

Oh, and if she feels sorry for herself, just remember it could be worse. She could have wrecked and injured/killed someone..
 
Blowing a .22, she's going to be in for a very long ordeal. My buddy got a .08 in his car without driving off on his 21st birthday outside the Novi Post Bar because the cop said his tint was too dark and pulled him over as soon as he started the car. I used to drag him over to JAMZ in Westland so he'd have to blow on his random days. It probably ended up costing him around $3-4k but in the end he got it wiped off his record for complying. But a .08 without driving and a .22 while on the road are very different.

this is a criminal offense not a traffic offense
 
Im sure they took her actual license, but they shouldve given her a paper license to use until sentencing. She still has driving privalages until found guilty. Shes going to lose it for at least 30 days, then a restricted...to and from work and/or school. Prob going to need to do random breathalizers/drug tests for the whole time shes on probation also, which is probably also for a year.

She will prob also need an ignition interlock installed with the restricted, approx $200 to install and $80/month

She'll prob take it pretty hard for the .22 also, thats almost 3 times the legal limit. Thats like 11 beers over 3 hours
 
you guys keep leaving out company van

I do not know of any company the would have her on their insurance
my record was checked once a year while I had a company car
comercial insurance carrier's usually only allow no more than 4 points for employees
 
Oakland county? Prepare for a head socking. A buddy's son did some jail time on his 1st offense. He has NEVER been in trouble with the law nor did he have a bad driving record. I can't remember the judges name, but it was a woman. She is the WORST judge to get in Oakland county.

Same thing happened a couple of years ago to my wife's friend. It was the girl's 1st offense and she ended up spending 5 days in jail and it cost her a ton of $$.
 
Spending time in jail is dependent on the judge. My judge in Canton was a complete a hole, but even when I violated my probation he said 9 days in jail or 15 days work program.
 
I JUST finished up with mine.... I was pulled over for a burnt out headlight, I blew a .10 and a .09 I was arrested 1mile from my house. They knocked it down to OWI which is 4points. My lawyer was dirt cheap (friend) and my total court cost and fines were $500.00 I DO NOT loose or have ANY type of restricted license at anytime. Im on 1year NON-reporting probation. I got off light according to what happens to everyone else i guess. I had an honest 4draft beers (talls), which is about a 6pack from 9:30pm until about 12midnight. I drank a few glasses of water and left about 12:45am to head home. Im about 210lbs and when i was pulled over I blew what I previously typed. I could see my damn street :(
 
hopefully a big one so she will learn, not sure why people still try to get away with this...maybe she can test the super drunk limits?

Sooo, you are mad because the judge was an asshole when you got a DUI and that you violated probation?

I read somewhere most DUI's happen within a mile of home. I also read beaters and vehicle defects were another reason. I took that as...........don't go home if you are drunk and drive something that is in working order. :lol:
 
oh, and I don't feel sorry for anyone who gets in trouble for this...its not like you didn't know better. thankfully nobody was killed.

Ya, the vehicle I had was a real nice car, I guess the headlight must have burnt out very recently because I hadn't noticed it. Also I didnt think i was drunk or even questioned myself. I would not leave a bar,party, or whatever if i felt I was over the limit, or if I felt I should just not drive. It was a fucked up situation that shocked me. I think I would have been let go if the cop hadn't been trying to impress his rookie.
 
.... The reason I stated what I did, is to get the point across that he deals only with traffic cases. He has does everthing thing from drag racing to Dui. He has been a Oakland county Laywer for 26 yrs.
 
Is losing the license mandatory for blowing that high. One of the layers she talked to suggested pleading it down to a impaired. Another suggested pleaing it from a 625 (1) offense to a 625 (3) with 4 points

BUAH HA HA HA HA HA... No prosecutor will allow her to plead to impaired when she qualifies for super drunk. While it would be nice, that attorney is simply telling her that to get the retainer. I used to work for Bay County Prosecutor's Office under Joe Sheeran (now Judge Sheeran) and I only allowed a person to plea to impaired if I thought I would have a hard time proving otherwise.

If this were Livingston County, a certain APA there does not plea down anything, either plea as charged or go to trial, those are your only options.

BTW: I bought Novi Judge Bondy's old home in Milford.

I was going to say the same thing. Obviously the Judge's stance on drunk driving was far more important than the risk he put everyone in by driving under the influence. :shake:
