Ford Lease Questions - Buy Back

Hey Guys,

I have a 2015 Ford Escape, the car was less than a month old when it went in for transmission trouble. The car has been out of service for 17 days(18 counting today).

Is there any other laws or regulations besides lemon law where I can force a buy back? or am I forced to wait another 12 days until lemon law comes into affect?

Possibly the worst part is the dealership and Ford Engineer's do not whats wrong with it. They have stated there is several other Escapes around the country with this issue, all of them are sitting until Ford figures this out.

Advice/Input appreciated.

IIRC

3 valid attempts at the same repair

30 consecutive days or more in the repair shop

Why has it been there for 17 days so far? Is it waiting on parts or are they still trying to diag it?

They have replaced the valve body, clutch packs and trans mounts. Still sitting there because in the service manager words "We have no clue what is wrong with it"

Unless I misunderstand the law, its just 30 days out of service. From the SOS site:

A defective vehicle is one in which the same problem has not been repaired after four attempts, or a vehicle that is out of service 30 days or more for repairs. The first report of the defect must be made within one year from the date of delivery to the original purchaser or lessee or during the term of the manufacturer's warranty, whichever period is shorter.

You're really not a candidate for a buy back yet. You do need to ask your service contact to get with their Ford Parts & Service Rep and voice your concern. I assume you're in a rental car? If not, I would ask for that. More than likely they will repair the vehicle according to Ford's instructions. If the vehicle is still having problem, the dealer can escalate your concerns with the Parts & Service Rep. Remember the dealer is on your side, they did not build the vehicle, they are only sourced with repairing it according to Ford's guidelines.

I know by Lemon law I don't have a foot to stand on yet, just wasn't sure if there was any other legal action that could be taken because the car is so new.

They do have me in a crappy, stinky rental but it is better than walking. I know the dealer didn't build the car but pretty frustrating to take so long to fix a car with 800 miles on it.

I would ask for a different rental. No reason you should be stuck in a POS rental when you have a brand new Escape torn apart. The dealer can get Ford to foot the bill for some if not all of the rental in this situation. Next time you need a new one call me. I can guarantee it will be perfect, but I'll take care of you if/when it needs service work.

I was aware that your a sponsor on here, just a bit of a drive. You will definitely be getting a call from me in about a year and a half from my understanding of Ford Lease pull a heads. The drive is well worth not putting up with the lack of this dealers ability to take care of this in a timely manner.

We bought our last new car from Matt and never had to go to the actual dealership.

our of curiosity, why wouldn't Ford foot the whole bill? This infuriates me with car dealers. The car doesn't work and they have it for an extended time and they act like it's an act of God to put you in a vehicle. When I had my Ram in the shop for about a week while they worked out an electrical issue, I was given a rental of a compact car. I bitched that I had a $45,000 truck in the shop and they put me in a $18,000 Fiesta. This happened as I was getting ready to move and was counting on having a truck to move things in. I had to rent a truck from Uhaul for a day to address it. On top of that, all costs involved with the vehicle other than the rental were my responsibility. For instance, I had to take my dog to the vet. She left white hair in the car because of it. Got charged a $150 cleaning fee. Told the dealership they should pay it and they told me it was my dog and my problem. I complained to Corp and they simply said that their policy is to give compact vehicles and all fees are on the renter, not the company. It's horrible customer service.

To be fair, the second time it happened I went to my sales person and they got me a truck off the lot to drive for the few days they had my truck, but it shouldn't take me having the sales person work magic behind the scenes to be taken care of.

It's just how the manufacture has it set up. Now you see why it's a good to have a relationship with your salesperson. It's amazing what a QUALITY salesperson/dealer can do for a customer.

He delivered to me in Toledo (Temperance) when I bought from him.

That was just because I felt sorry for your wife :pow:
