Won a small claims... advice on how do I collect?

Gone to court yesterday and defendant didn't show up so the judgment went in my favor.
The guy ownes a small home remodeling company, doesn't own a home and I don't have any bank info to do any kind of lien on.....
What can I do to collect from this loser?
 
Call up the court and see about getting a writ of garnishment. You have to wait 21 days after the judgement date though. The court will send the writ to any financial institution he holds an account and take whatever he has in his accounts until the judgement is fulfilled. He won't get a heads up, it will appear randomly then the bank/credit union will freeze the money for 28 days then send it to you.

You have to find out where he banks though. The other thing you can do after 21 days is file a writ of seizure. Sheriff will go to business to collect and seize and sell items to pay your judgement. They can also padlock the building and have an auction to pay your debt.
 
Going through this now with my ex-employer. I have 3 more days to wait. I know they never have a lot of money in their account and won't keep trying until the money is there. Writ of seizure works well for me.

Anyone here remember the APE auction? Guess who that was for?

Works out of his truck..
 
He lives somewhere. They can take everything but his clothes and bed. If he owns the truck they can take that too and all his tools.

What if he's Incorporated and the defendant was the company not the person?

A buddy just went went through this same type of deal. Prepare to wait a loooooong time to get the money. He finally ended up filing a paper with Secretary of State and they suspended his license till the money was paid.
 
You're Italian and wondering how to collect?? Irony? Lol jk

Know anyone that has done work for him that might have received a check from him??
 
Find out any titled property he may own and do an execution of property on his truck, car, motorcycle, house, boat, etc...
Go to the secretary of state and fill out a freedom of information form and pay them a fee and see what he's got. Then you can petition the court to execute and seize and liquidate.

I'll put his full name out there in a later once I start getting some kind a collection going but his first name is Kevin in case someone's having a house remodeled from that name...
 
On that note, it would be nice to have a log-in only forum with a 'douchebag directory' where members can list the names & stories of some of the real winners we all meet.
