step daughter took my car while we were out of town and crashed it!!

Small claims court to not only re-reimburse you for the deductible, but sue to re-reimburse the insurance company.

If she took the keys but he took the car out of the garage - they're both likely to get charged for auto theft. Just because a group of people rob a convenience store, it's not the guy who the cashier handed the money too who broke the law :)

she took keys he wasnt there, he comes over to take his "baby momma" out she says lets take my dads car and tosses him the keys he has resonable doubt that she has permission to take car

Orrr

"Yo' step-daddy got a nice cah! Get me dem keys sumtime, shawty!"

If he didn't know it wasn't stolen - WHY would he run from the car after the accident and leave the car? ;)

all this...what happened to ass kicking? People used to be afriad of the cops, because if they were called (as an all out last resport) all hell is going to brake lose, now we call the cops to help parent our kids. I was talking with a Police officer one day, she was respoinding to a kid calling on her parents for spanking her, the cop says...just as long as you dont use a closed fist...best her ass. I feel extra sorry for you, I have a step son. Step kids are tricky...espically when they start f'n up.

I mean she is already prego...she does not need anything hurting her getting a job in 18-24 months.

I hope the boyfriend stays gone!

I agree were in for some shit when this generation gets lail bit older, peole do not p[arent anymore its fucked. Kids don't know boundrys or respect at all. something as simple as waiting for traffic to clear when I was a kid to now kids just blatinly (sp) walk into traffic and expect them to stop and then wait while they lally-gag and take there fucking time. If you look at them in a disapproving manner while they do so they bitch at you and call you a asshole and will go as fgar as to get aggresive. Shits out of control, my kids will respect me the way I respect my parents.

it is likely the insurance will require you to re;port the car stolen before they will cover the damages. I recall reading about a case like this 5=10 years back
Unless the guy driving was excluded from the policy, the insurance company has very little reason to deny paying the claim. Now if the owner tells the insurance company the car was taken without permission, then they can demand a police report be filed before they pay.

I'm pretty sure the insurance company can bounce a claim if you let an unlicensed person drive your car. If you did not let the licensed person drive , then they must have stolen it.

He doesn't have to be excluded from the policy unless he lives in the household. If you don't live there and take the car without permission, it's a stolen car. You are correct about requiring the police report. If the daughter lived at the house and took the car, she would need to be excluded for the insurance company not to pay. She is a 'Named Insured' unless excluded. This is the reason a parents car insurance goes up with a 16 year old in the home. He is automatically a Named Insured unless the parents specifically exclude the 16 year old. As when they do, they need to make sure the kid knows what this means. Unless she was excluded, the OP maaayyyyyyy still be on the hook if she lives in the house, regardless of permission. This falls into a gray area and different companies may interpret this different ways.

My point was that if the owner did not report it as stolen and made an accident clam, it should be covered. I didnt notice the guy had no D.L. when I said it.
