ROPD Woodward Parking Ticket Harassment

I had mentioned this ticket I got in a thread about Woodward from last weekend. I'm not just laying over and paying it mostly out of principle and this has resulted in kind of an interesting discovery. The officer that wrote the ticket still hasn't put it in the system, ticket was issued on Friday. I posted on Facebook about the situation and someone suggested a lawsuit for harassment as a form of standing up to prevent this sort of harassment from happening. Basically, I'm making this post to get people's thoughts on this sort of thing.

Here's the whole situation for those that care to read. The above was mostly a summary for the TL;DR crowd.

Friday night I go out to Woodward. The parking in front of the Potbelly's/Caribou building was full. I parked in front of The Vitamin Shoppe, which is in the same connected parking area and went and got a sandwich at Potbelly's. I came back to find a parking ticket for "Private property without permission." The Vitamin Shoppe does not have a sign stating that this was parking for The Vitamin Shoppe customers only. In fact, the officer even gave The Vitamin Shoppe employee that was cleaning up after closing a ticket for the same thing and he had to come out and argue about it. They were also ticketing cars at the credit union between The Vitamin Shoppe and Caribou.

Monday afternoon I went to the RO court house because the ticket says on the back "YOUR VIOLATION MUST BE SETTLED AT THE 44TH DISTRICT COURT" and also says that the fine increases after 72 hours so I had to do something Monday to be within 72 hours of Friday night. I was told then that the ticket was not entered in the system and that I should just call the number on the ticket. They also said the 72 hours doesn't start until the ticket is in the system.

I called again this morning to cover 72 hours from Monday and was again told the ticket was not int he system and to call back tomorrow or Friday.

Are they just hoping everyone that got a ticket will pay it, they'll generate that money and not have to actually enter the tickets in the system, supporting that this is really just 100% harassment?

From the law suit stand point, I don't see there being any money to be made, and I don't have any money to throw at a lawyer. So unless a lawyer was looking to take on the cause or there were enough people willing to throw money at a kickstarter or something I don't have any way to make that happen. Is there a point? Would it help? Would it hurt? Thoughts?
 
Im not sure I have any advice to give, but I like where the OP is going with this.

Also glad my tax dollars are going to a royal oak police officer's salary so he can patrol a parking lot harrassing people about doing something harmless :shake:
 
Do what you have to do to fight the ticket. If you do have a receipt for a business in that parking lot around the time the ticket was written, you did nothing wrong and should prove this yourself in court.
 
This is the same reason I dont go to bike nights anymore, worked with a parking enforcement cop at Fanuc who would brag about all the tickets he wrote

I am also in a similiar situation in regards to the ticket not being in the system.

I recieved a tint ticket, didn't have doctors note in the car as I am selling it and didnt want private info in the car, my fault. Recieved the ticket which states I have to make a court date as its a 'non-waivable' ticket. I called the court and was told they will not give me a court date, I need to either just admit guilt and pay, admit guilt with reason and send in a letter and plead my case. Basically pay the fine is the only option it would seem as I have no means of pleading not guilty unless they change their mind on allowing a court case (waste of time!!!)

Regardless I got my recomendation for window film renewed and have the 10 years worth of renewal records and such in the car and ready to take to court. I will not pay the $115.

That being said they still did not have the ticket in the system as of 12:20pm today. Its an electronic ticket, how can this not be in the system!!!

If you have a reciept fight it!

It sounds like someone needs to go to a news station, or find out a way to formally report this to the state for corrective action.
 
I got one last year and just forked over the money..

also Last year i, along with about 20 others got nailed with loitering tickets at another parking lot in pontiac, off of ww, it was an office building that was closed, so i guess we were 'loitering' but it was still a real pita..

good luck, ww it becoming horrible.

At the end of last year Pasquelles even had private security preventing non patrons from using their oversized lot.

dont bother fighting it, Unless the tint is on you license as a restriction, its illegal, Dr note dont mean shit
 
I've done the letter option. I got a ticket for parking in a handicap outside I'd a restaurant. I forgot how much it was for, but if you knew me you'd know that I would park on the moon before I took a handicap spot. Shit, I make my mother walk (needs exercise) even if there are tons of spots.

Anyway, I get the parking ticket and was shocked because I didn't even know it was a handicapper spot. (No sign and pretty much no paint left on the spot.). So I came back later with a camera, took photos and wrote a letter explaining what happened, then basically DEMANDED that they get someone out there to fix it.

Two weeks later, I get a letter back from the Mayor exonerating my ticket, and enclosed a picture of the newly painted handicap spot.

Your results may vary, but I'd think its worth a shot.

Not according to MCL 257.709 - DR note does mean something. They definitely word this shit so confusing though.

Im blind in one eye. I had a dr note, tinted both cars out. Cops fucked with me all the time, its really up to the cop to accept the note or not and most wont anymore. I have the restriction on my license. Pain in the ass to get but the joy of not getting stopped for tint makes it worth it

(e) A special window treatment or application determined necessary by a physician or optometrist, for the protection of a person who is light sensitive or photosensitive, if the owner or operator of a motor vehicle has in possession a letter signed by a physician or optometrist, indicating that the special window treatment or application is a medical necessity. However, the special window treatment or application shall not interfere with or obstruct the driver's clear vision of the highway or an intersecting highway.
