RANT: Pissed off at my employers. Workman's Comp. related

July 10, hurt my right wrist at work. (long story short, I stumbled and cracked my wrist over the side of a steel enforced bin.) Nasty "lump" that sticks out like a golf ball on the side of my wrist. I was to return to work that day on "light duty" with the right arm by Concentra Medical. No lifting over 5lbs. I was to stay on these "light duty" restrictions until my follow up appointment on Friday, July 13.

By then, the injury had become worse. Hurt to make a first, no strength in the hand, couldn't bend the wrist with out severe pain. Then, I was then given the restriction of "no use of the right arm."

Because of the restriction, my employer stated that I would not be able to return to work until I was given clearance from Concentra to return to work with no restrictions.

This means, per company policy, I would have to use any benefit time to cover my absences from 1 to 7 days. After 7 days, but less than 14, would be covered by my employer. Anything over 14 days, would then be paid out by the insurance company, crediting me back all benefit time used, and my employer would also recover anything paid out.

I had another follow up on July 17, to which I was given the exact same restrictions, no use of the right arm. The injury had not started to get better, but it was, in fact, becoming worse. I was then referred to a hand specialist to see exactly what could be wrong on July 24. So, that means, all of last week, I was not allowed to return to work and had to use my benefit time.

I went to see the hand specialist yesterday, who recommended I get an MRI so we can see what is really wrong. He fears it may be moderate to severe ligament damage. His words were, "With what I am seeing in the swelling, and what I feel in the area, leads me to believe that there is some serious ligament and/or tendon damage done here." All x-rays taken showed no broken bones or fractures. I was then given the exact same restrictions for work of no use of the right arm. This week is being paid for by my employer, who has stated, I am not allowed to return to work, until I am given a release from the doctors of no restrictions.

Today, I received a call from my Human Resources manager stating I am to report to work tomorrow, Thursday July 26 for "light-duty." The same employer who said I could not return to work until I was given a release from the doctors of no restrictions.

I still have a another follow up scheduled with the hand specialist for July 31 to hopefully go over the results of the MRI, and make any necessary plans from there.

What has me so pissed I can hardly see straight, is I wasn't allowed to return to work after the first "no use" restriction, but now? All of the sudden, I'm allowed. Why the sudden change? These were the same people that stated up and down, that I am not to report for work until I have no restrictions.

I have to report back to work tomorrow, while I wait for the workman's compensation people to clear me to go get my MRI, and then possibly surgery or rehab.

start jumping through ALL the hoops the employer puts up. the first one you miss is grounds for firing. document everything and call a workers comp attorney.
 
I'll be going to work. I have to. I can't afford to go unemployed because of this. The workman's compensation claim remains open as long as I'm under the care of Concentra/specialist. I have a MRI that is to be scheduled, and another visit to the specialist.

Everything is documented. I've been very diligent making certain I have copies of every single piece of paperwork to go to the employer. I'm covered. I just have to go through the visits and work.
 
I think they are going to try to fire you tomorrow. Make sure you don't so much as go to the bathroom without permission, even if you have to sit and stare at the wall all day. Get an Ace bandage and wrap your hand to completely blocks your fingers, so you are not even tempted to use them.

And like WikdSVT said, jump through every hoop, just don't use your hand. They are probably going to send you home, if they can't fire you, then try to reset the clock.

Next time don't answer the phone.

If they send me home, that is to my benefit. The workman's compensation claim remains open until I am cleared in writing by the clinic now.

All I need are 2 more days off to meet the criteria of the workman's compensation claim. Once I have those 2 days off, which I will have for the MRI and then the follow up consultation, I will have completed the necessary 14 days away from the job due to injury. Then, I get my benefit time back for week 1, and they get their money back for week 2.

But again, what has me pissed is almost 2 weeks ago, I was told not to come back until I am restriction free. Now, it's no big deal.... just odd behavior.
 
Not sure why Roush gets such a bad rap around here. They have taken care of everyone I've seen get hurt here. I haven't seen a single person get let go that didn't deserve it.
 
Do you have doctor's note's and what date's do the stat ? Do they stat date's for appointment's or date to return back to work. I am going threw the same thing but my wrist is broke with two pin's to hold it back togeather. My doctor's note stated revised on the 11th which was first appointment. I had to get another note and fax it to work and atna stating another three weeks off of work. Which another appointment on the first of Aug. It's what the doctor's note stat and yes i had to use all my sick time/pay before my incurance kicked in.

They have a reputation for not wanting to pay anything they don't have to. I was happy with the way I was treated when I got hurt, but then again I was eager to get back to work.....so when they wanted me to come in and do limited mobility work I did. If he has limited work release, and from the nature of his injury.....I could see a Roush getting a big retro job or something and wanting him to come back to work to porter cars or just do the basic stuff instead of having to hire a temp to come in and do easy stuff.

Today, my employer informed me that all benefit time that I used for week one is going to be reinstated in 1 to 2 pay periods. And yes, I got it in writing. Also, my workman's comp claim is still open until I am given a zero restriction from the doctors. As soon as the MRI is scheduled, I will be in for that. And then likely surgery there after.
 
good luck with all that I pursued a carpal tunnel issue years ago with my 8 year factory job and hired a lawyer and the lawyer stated to me in initial consultation "your employer is going to try to get rid of you now because you are a liability to them" low and behold it wasnt a month and I got fired for something totally unrelated to anything and that FANTASTIC UAW didnt even try to fight for me hence the reason why I have no use for labor unions ever!!
I did my homework and found out that legally they (your employer) has to find you something to do light duty even if its jacking off with your good hand no pun intended lol

Sorry for the injury. Glad it sounds like your employer is treating you right.
