to start off, i left my previous job to return to school for 17 credit hours this semester. and i had enough money to live off of until i found a flexible, part time job.

so when i decided to do this, i ended up getting screwed over alot of money from a couple buddies, so i soon went broke.

at this point, the brother, of my girlfriends bestfriend, says he needs someone to help him (he owns a post-construction cleaning company). and it would be 10/hr cash.

well even going to school full time i put in countless 12 hr days and have worked over 100 hours in a 3 week period. i havent worked with him for the past 2 weeks. But i havent gotten paid at all. he said it was going to be when he gets paid from the builders of the houses, and they dont pay him til the house closes.

im trying not to get shitty about the situation, but i know its not just me he owes, he owes my girlfriend a large lump as well.

ive passed on other jobs as well due to the leisure nature of the job, and am totally regreting it.

i ask him maybe 1-2 times a week if he happened to get paid and all i get is a blunt "no" via text message or e-mail

Ive heard that builders are very reluctant to pay up...almost like pulling teeth. He shouldve said something to you prior to being hired that pay is slow. Being the way the economy is, and that you were told the builder doesnt pay up till the house is sold...you might be waiting for a little while. Id stay on your employers ass regardless. He owes you money no matter where it comes from.
 
thats completely stupid to agree to only get paid once the builder closes, your boss/ the owner is a dipshit. in a lot of cases nowadays people dont close for months/ years so you could be holding your D**K for a while and so could he. bad business practice. Ive had to wait 1.5 years until a house I built finally closed because the owners built way beyond their means (to the tune of 1 million over their budget). so until the final court hearings I never got paid

sorry that happened but it looks like youre stuck with whatever he says being that its cash/ under the table.
 
time for your boss to post a lein on the house if the builder owes money on the house to the workers he cannot sell it IIRC
 
If he has a service agreement with the company, that could prevent the lien. And it's not unusual to not get paid from a builder for months. I used to do this exact work. Had contracts with Toll, Ivan Hoe Huntley, and about 6 other mid range builders. Toll was the only one that requested a no lien contract. But they were also the best company for pay. Every week, as long as my paper work was filed.


As for your situation. Regardless of how he gets paid, if you agreed to the when I get paid you get paid work, then your out of luck. If he was really making money or really could afford the help he would have enough in the bank to pay 5 people hourly wages every other week. I mean, Supplies mostly cheap, gas NOT CHEAP. We spent thousands per month in gas alone.

Anyway. Good luck, but don't burn the bridge, until you see him go buy something brand new and your still not paid. Then kick his ass.
 
I did this shit for a company i worked for. it was bullshit! "you don't get paid till the customer comes and pics up his car".

In my eyes its the employers problem if he doesn't get paid. The deal between him and you should be separate and come out of his pocket.

I started out at a certain well known mustang shop as a rookie and got the bad taste of flat-rate from every angle possible. :shake: Never again will i be employed by "the little guy".
 
dealing with any contractor without a written agreement is like pulling teeth, the law is on their side(technically its on neither he just wins) if there is no signed written agreement. If you show up to small claims court with out a signed written agreement (first question from judge and or magistrate) it will be dismissed as one word against another. So if said contractor says I can not pay you until the home closes, technically even though it is a dick move since there is no contractual agreement he can do it. The window cleaning company I work for Previ did a lot of post construction and my boss got screwed a majority of the time; It has the potential to pay very well which is why people tend to go back time and time again. I know of one good contractor and Im sticking with him for as long as we both do business.

I just can't believe how many contractors and subcontractors allow big companies to get away with this nonsense.

Most contracts (at least in the IT field) are either Net 30, with a few rare ones being Net 90. This means the customer has either 30 or 90 days to pay their bill. Anything longer would be absolutely absurd.
 
the building field is NetWhenever, this is the way its been for decades now. they pray on the little guy companies because they know they have no choice but to work for them. then they make them jump through hoops to get paid. As for this guy your working for craig you being a cash employee presents alot of risks. There is no way he can cover you on his insurance if he even has any, and if hes operating with out it I would imagine that is illegal. More over so is him employing you for cash. Both points you can present to osha, along with any other practices you noticed. IE: disposal of hazardous materials, lack of safety equiptment... ect
 
my dad owns a semi dump truck and i know with some jobs he does he doesnt get paid till the jobs the pays out. You should have checked what the deal was at the beginning of the job. How and what i get paid is the first convo i have with my new or potential employer and it should be yours too. Dont be mad at him cuz you didnt ask the right questions.

i understand that is how the building business works, but my employer and of the builders for this contracting company are best friends, and the builders uncle is the owner of the contracting company, so i didnt forsee any issues when it was explained that i will not be getting paid. and ALL of the houses have been sold. 9200 sq ft house in b-ham we took 3 days to clean with 198 windows, 12 bed rooms, and 13 baths. at $.16/sq. ft, its a pretty big job. but the poeple moved here from new jersey and were laid up for an extra week due to plumbing fixture issues, so i know it is closed and sold, as well as every other house, so i guess its just virbadim (sp?)
