minimum wage question

As some of you may know, MI now is at 6.95 minimum wage for non agriculture, and tipped employees. Etc.

I had forgotten about this, BUT today at work (my part time job), I asked if I was going to get my base hourly rate bumped to the minimum wage.

My manager said that the person in charge of HR said we were not eligible. I make commission on top of that hourly rate. BUT, its not a tipped job; and the only exclusions I can find are for tipped employee's.

To anyone who has a legal backround, can you answer whether they are in violation of the MI law?

if you must know, this company publishes a "benifit rate" on my paystub. listed below the base hourly rate + commission dollars which gets averaged over 16 weeks. So that for vacation time, sick time, meetings and travel; we get this benifit rate. This usually is around 11.60-13.10 for most employee's in my position.

WHERE IS MY $.20/hr, lol. really I could give 2 shits, but its the fact that I believe they should be paying it.
