Mini tort question

Ok so I was at my family reunion and talking about how my car was hit and blah blah. My uncle told me I could file something called a mini tort and because my car was legally parked and was hit and run I could get some $$$ from the state is this true? If so how do I go about filing? Sounds like he was bs'in me
 
im not to sure on your situation but here is how that all works.

since your car was parked and it was hit, the other persons insurance is responsible for the damages. the only way you can get this is or the mini tort is if you know who the person is that did it. you cannot go towards the state for the mini tort or the damages.

if you dont know who the person was that hit you. then unfortunately you are SOL if you do not have full coverage on your own vehicle.

Call your insurance, they will direct you. If there is a police report get it, and call their insurance, after you get a estimate. They (other persons insurance) will want if faxed over with a copy of the police report. Then they wi decide if they are going to give you a check or if they want to challenge it. If the person was given a ticket you will have a great Chance of a pretty simple process. I'm going through it right now. Luckily the person that hit me has the same insurance as I do, so it sounds like it is a easier process by the way the lady acted and said.
 
Do you have broad form collision? If so, you won't be able to file. My fiancée was hit recently, and when we tried to file, our agent told us we weren't eligible to do so because of our policy.
 
If you have broad form collision, get the police report and the deductible will be waived. If you have basic collision, you are responsible for your deductible. If for some reason you have limited collision, the insurance company will pay 100% if you are not at fault, but nothing if you are.
