A man suspected of being involved in a burglary late Thursday on Anderson Street was found dead shortly after midnight in the nearby Scottsdale Estates subdivision, where witnesses reported that multiple shots were fired, Milan police said.
Police said the man is in his mid-to late 20s, but declined to release his name as they work to notify next of kin.
He was found dead shortly after midnight behind a car parked on O'Brian Drive in the subdivision, which is across Platt Road from Symons Elementary School. Interim Milan Police Chief Jeremy Nieman refused to say Friday afternoon whether the victim had been shot. An autopsy is scheduled for Saturday.
Police also wouldn't say whether anyone has been taken into custody, but said no charges have been filed. At least one other person participated in the burglary, police said. Police said property was stolen, but declined to be more specific.
Milan police were executing a search warrant late Friday morning at the home that was burglarized. Michigan State police and a Monroe County sheriff's K-9 unit were assisting.

Shawn Hall, 37, was sitting on his couch around midnight when he heard a “really loud scream” and a couple of gunshots, he said. He looked out the window, grabbed his wife’s cellphone and dialed 911. He ushered five of his family members and a friend to the basement. At one point, he saw what appeared to be a man running toward the back of a home across the street, he said, but he couldn't make out who the person was.
When officers arrived, they attempted to resuscitate a man lying behind the car parked on O'Brian Drive, he said.
“It’s not the sort of thing you expect to happen in a small town. It’s disturbing to say the least," he said.
Dan Weber, 56, said he had just gone to bed when he heard two loud shots at 11:54 p.m.
Weber, who moved to the subdivision in 1999, said it’s the best neighborhood in which he’s lived. “I know everybody that lives in here. We’re all at least acquainted. I’m shocked. I just never would have expected it.”
Police said they expect to release more details Friday afternoon. Anyone with information can call police at (734) 439-1551.


from what i have gathered, two guys broke in to the house and duct taped the guy and his mother. Pistol whipped the guy a couple times then stole his plants (guy has card). Two culprits take off on foot, guy who was robbed gets loose and grabs a gun and chases down the guys putting a bullet in one of them.

Sounds like murder or at least man slaughter to me. I'm sure a good lawyer may get him off, but from everything I've read you can't chase someone down and shoot them. The threat to his life was over after they ran off.

And now he will spend the rest of his life in prison for murder. It was after the fact.

I totally agree, I wasnt trying say he was in the right by chasing and firing at them.
 
Just another risk of being a "medical marijuana" grower. The more people that know, the more risk you take. Remember "medical marijuana" is still a drug and people will rob and steal to get drugs.
 
I heard sirens last night when I got home... but didn't think anything of it.

If the guy really did chase one of them down and shoot somebody who was fleeing, he's got a serious legal fight on his hands.

I wouldn't convict him
 
its hard to say how jurors would think, especially with as many robbery's, and car thefts happening lately. I think thieves will start to see less leniency with juror trials, but thats just my opinion.
 
that too, but if you live in a home with other family members you should think about the danger you may put them in by growing something that attracts thug's and lowlifes.

agreed. I've got ZERO problem with those who smoke pot... medically or otherwise. But, like you said, it IS going to attract some attention from a bad element.
 
I think it will be difficult to convince a jury that you honestly and reasonably believed that you were in imminent dangers of death or great bodily harm from somebody who was running away from you.

ENROLLED HOUSE BILL No. 5143

AN ACT to clarify the rights and duties of self-defense and the defense of others.

The People of the State of Michigan enact:

Sec. 1. This act shall be known and may be cited as the "self-defense act".

Sec. 2. (1) An individual who has not or is not engaged in the commission of a crime at the time he or she uses deadly force may use deadly force against another individual anywhere he or she has the legal right to be with no duty to retreat if either of the following applies:

(a) The individual honestly and reasonably believes that the use of deadly force is necessary to prevent the imminent death of or imminent great bodily harm to himself or herself or to another individual.

(b) The individual honestly and reasonably believes that the use of deadly force is necessary to prevent the imminent sexual assault of himself or herself or of another individual.

(2) An individual who has not or is not engaged in the commission of a crime at the time he or she uses force other than deadly force may use force other than deadly force against another individual anywhere he or she has the legal right to be with no duty to retreat if he or she honestly and reasonably believes that the use of that force is necessary to defend himself or herself or another individual from the imminent unlawful use of force by another individual.

Sec. 3. Except as provided in section 2, this act does not modify the common law of this state in existence on October1, 2006 regarding the duty to retreat before using deadly force or force other than deadly force.

Sec. 4. This act does not diminish an individual's right to use deadly force or force other than deadly force in self-defense or defense of another individual as provided by the common law of this state in existence on October 1, 2006.

Enacting section 1. This act takes effect October 1, 2006.

medicinal pot is a joke. nothing more than a slap in the face to law enforcement.....
