Have a small claims court date on October 11th.

I got my small claims court date today. I have a jewler who I gave $1100. towards a ring that he had in his showcase. 3 weeks later i got laid off work so I went in to cancel the layaway. He then told me he won't give me my money back because his policy is no refund on layaways. Yes it says it on the layaway receipt but they don't tell you their policy before you fork over the money. So I went in a few months later because i did not know what to do with my credit. So I asked if they had gold coins or bullion. They said they could order it. When i told them I would like to use my store credit after they gave me a price. they claimed i can only use it towards merchandise in the store. Anyone have any suggestions for my upcoming court date. Anyone ever been to small claims court in Warren?
 
No offense but the store policy was disclosed and you're more than likely not going to win. IMO you should just go in and pick something out thats worth the grand you gave him.

I think it may have been different if less time had elapsed since you requested a refund. It may have been acceptable a day or two later, but not weeks or months. Just my opinion.. :)
 
The store policy was disclosed after he took my money. My problem is you could walk in with a grand and if he did not have the item you wanted he would order it for you. He is not treating my money the same because he already has it. What next, I can only buy money clips with the $1100.

Sounds like a case of "Sucks to be you, but I'm O.K." read before you ever fork over money on layaway, I'm not 100% sure but this may be a case of lesson learned :dontknow:
 
Your screwed and will lose. The judge will ask him if there is a sign posted anywhere in the store with said policy. He will then ask if it was on the receipt and if you had a problem with it you should have backed out then.
 
There is no sign posted anywhere in sight. You get the receipt after you give them your money. Kind of hard to back out of the deal after. You would think as a customer they should have you sign something. If I lose, I lose. But I will make sure i win in the end.
 
I had a small claims case in Warren against a former tenant. They made us do mediation before actually scheduling a court date. If you can't reach an agreement with the mediator, then they schedule a date.
