Gun Guys May Know The Answer To This One

One of my employees asked me this question today,

"I'm being charged with Domestic Violence, waiting to go to court on it, can I buy a hand gun while waitng to go to court" ?

I was there when the "crap" went down with his old lady, its a clear case of her making a false report and trying to fuck up his life.

He is a good guy, NEVER has, nor would he EVER hit a woman, but he has a chance to get a gun at a SMOKING deal.

So the question is, Can he get a permit to purchace while waiting to go to court on a "domestic" charge? Yes he was charged for it, but has not gone to court yet on it.

I would say until the case is closed he should be OK, but after that he might not be allowed to have a CPL
 
1. Yes, he can purchase a firearm.
2. Yes, even IF he gets convicted, as long as it's a misdemeanor he can still purchase and own firearms
3. It may affect his ability to get a CPL in the future.
4. He should file a PPO against her, because if she files first, he will not be able to get a CPL or a purchase permit.
5. This sounds like a great question to ask a lawyer about, rather than random internet people
6. I am not a lawyer. Any information given is just my opinion and is worth exactly what you paid for it.
 
Actually he would be disqualified under federal law if convicted:

18, U.S.C. §922 (g) (9)
Has been convicted in any court of a misdemeanor crime of domestic violence

If the charges have already been entered and made their way to NICS it's probably going to bounce him immediately.
 
Domestics are handled differently in the system then other misdemeanors. There are specific laws that target domestics. Does he have a lawyer that is going to handle the criminal case?
If so, he should probably talk to the lawyer.

Thats where it gets sticky, there are provisions made SPECIFICALLY for Domestic Violence cases...
 
Purchase, maybe. CPL, I highly doubt it. While waiting for mine, I had to listen to a good 50 people talk to the board. Two guys had domestic charges, one was a long time ago. Neither were awarded with a CPL. They did say, however, they could talk to some other people or do some class, then reapply and see what happens.

can't purchase...it is a condition of the bond after they are arrested. Which as I said...is entered in the computer after they are released. Pretty sure they get a copy of all that stuff. Have him look over his arrest paperwork.
