Girlfriends 1st offense DUI in Novi- what may happen

Girlfriend got pulled over in Novi for DUI, 1st offense for her, no prior traffic tickets. She blew a .22, .18, .21. She is waiting for attorney to schedule discovery. She has a company van she has to drive between substations, She is a electrician. What kind of fines could they smack her with. Could she lose her license?
 
--30 days suspended license/150 days restricted license (automatic), plus $125 reinstatement fee
--Up to 93 days in jail
--Fines of at least $100 up to $500, plus court costs
--Probation up to 2 years
--Up to 360 hours community service
--$1,000.00 "driver responsibility fee" to secretary of state for two years

Ouch, can't believe a DUI can cost you 10G's...... I almost feel bad for her, but come on... a .2??? Seriously?!
 
Oakland county? Prepare for a head socking. A buddy's son did some jail time on his 1st offense. He has NEVER been in trouble with the law nor did he have a bad driving record. I can't remember the judges name, but it was a woman. She is the WORST judge to get in Oakland county.

Now I know know a guy with 2 in Wayne county within a year apart and he didn't do ANY time.

Depends on the judge, I had a DUI 1st offense almost 10 yrs ago prob cost me 4k in fines fees, had a year probation 9 months restricted license to and from work only. Oh yeah and the classes the classes are the worst watching those movies of Drunk Driver Crashes/Fatalities!!! :puke: and hell I only blew a .11. so Good luck to your girl and I'm glad her or no one else was hurt.
 
Since she was twice the legal limit .08, she might just qualify for "SUPER DRUNK Charges".

Lose her license, fines, costs, drivers responsibility, attorney fees - expect to pay about $5k when all said and done
 
That is the max that they can give you but it all depends on how good your lawyer is...(how much you can pay) but talk to a few lawyers and if one knows the judge she might get lucky

Is losing the license mandatory for blowing that high. One of the layers she talked to suggested pleading it down to a impaired. Another suggested pleaing it from a 625 (1) offense to a 625 (3) with 4 points

Nope..... she qualifys.

As of the effective date, a driver with 0.17 BAC will be eligible for the following more severe punishments:

1. Possible imprisonment of not more than 180 days (as opposed to not more than 93 days)
2. A possible fine of not less than $200 or more than $700 (as opposed to not less than $100 or more than $500)
3. At the defendant's expense, mandatory participation and successful completion of at least one alcohol treatment or self-help program for a period of not less than one year
4. A mandatory driver's license suspension of one year. After 45 days of absolute suspension, a restricted license may be issued if an approved breath alcohol interlock ignition device (BAIID) is legally installed in the defendant's vehicle. A BAIID prevents the vehicle from starting if a breath test reaches 0.025 BAC.
5. If the driver violates the terms of the restricted license, or operates or attempts to operate a vehicle with a BAC of 0.025, an additional mandatory one-year suspension shall be imposed.

Expect around 10,000 - 15,000 in fines/lawyers fees .
 
Eligible doesn't mean manditory. Some of that can depend on her age (under age drinking), record or lack there of, and the mood of the prosecuting attorney. What is missed in here is the fact that she may be subject to random breathelizer tests (at her expense) and having her vehicle booted (at her expense) during the time of her suspension. Oakland County is tough. The cost of the DUI will probably be at least $5K and that doesn't include the extremely high cost of car insurance. If she drives for a living she could be out of a job if she isn't given a hardship restricted suspension. That or hope she has 30-45 days worth of vacation time.

hmmm, they did keep mine but I was able to just go get another one at SoS and when I was sentenced my license was restricted for 30 days, I couldn't drive after midnight or something trivial like that.

I was only a .10 but I will tell you that it was the most horrific time of my life and unless she makes very good money this is going to follow and haunt her for the immediate future and she will be paying drivers responsibility for the next 2 years.

The judge told me that because I was just over the limit that he wanted me to report to probation only 5 times, and attend 1 MADD seminar, all of which you have to pay for. This devastated me financially, I lost my job, couldn't get another job, and it pretty much bankrupted me as I had to take cash advance from credit cards to pay attorney's and fee's and then I was not able to make payments on some things, putting me in default. Once I did find a job, I remember working and getting paid and having to pay it all to the city. My first few paychecks came and went toward fines. Times got very rough in 2008 and I was not able to make a drivers responsibility payment so they suspended my license and to get it back I had to pay over 100 and pay the responsibility fee. It never ends and like I said unless you are very wealthy or a celebrity, a DUI is devastating to the average person, especially in times like this.

She will most definitely lose her job if driving is a requirement to work. If she has a CDL she will lose that.

Honestly it's hard to have sympathy. I feel bad for people who are blowing .08's and getting nailed but this girl was plowed and at that level of intoxication is a threat to everyone on the road.

I bet she never does that again. I drank 4 bud lights over 2 hours the night I got stopped and I have never made that mistake again.
 
my mother was almost killed by a drunk driver the weekend of time trails for the Indy 500 when she lived IN Indianapolis... The accident was so bad that it was the headline news that day, more so than the Indy 500 itself.

In fact, her heart did stop a couple times and the EMS revived her on the way to the hospital. She was there for WEEKS.


I have no love for drunk drivers.
 
One of the judges in oakland county got a DUI not too long ago. I dont recall what her name was

but yeah they make you take an alcohol eval. Depending on how the score comes out is how your sentencing goes.
