DTE rant !!!

I read the other guys post about DTE screwing him , well this morning around 9am they started with me.

woke up this morning around 9am and my son tells me his tv shut off on him. long story short is I have no power , call DTE and theres no outages reported , so after waiting on the phone to talk to a human they tell me my power had been shut off ( my 160dollar a month bill is paid on time , 95%of the time lol ) and I just paid it last week. I tell them my name and account # again . they say yes sir your paid and we don't see any reason your powers off , Hmmm , oh wait here it is , somehow theres 2 accounts on my address ? and they shut me off because the people that lived there before me never paid or took there name off the house and there bill rised to the point of shutoff ( don't make since to me but I don't work for DTE ) . ( only bill ive ever gotten in the mail was my own ) ive only lived there just a hair under 2 months and its a rental house . so after I explain that im not JOHN whoever all they can say to me is well its a past due balance and I need to pay it to restore my power ( nope fuck that , send me to someone else ) the lady I get transferred to is a little nicer and says I do not have to pay it and they will take care of the issue with the other name being on the house, BUT !!! they cant restore power till Wednesday because they shut it off at the pole ( ummm nope fuck that , you guys fucked up you fix the issue today ) ive got a 7 year old son and a pregnant GF at the house I need power ASAP , so after being dicked around a little more I NEVER once got a im sorry but I do get her to tell me someone will be out to turn it on before they close today..... A little longer story short is my GF took my son out school shopping and went to her parents and what not and gets home at 630ish and theres still no power ( ive been at work since around 130pm ), DTE is now closed , looks like my power will be on tomorrow hopefully , meanwhile everything in my fridge and freezer is unthawed or is now turned into mush.

What can I do , probably nothing but its worth a shot
 
He doesnt know , hes not the greatest landlord . Ive been here almost 2 month and havent seen him yet . Only phone calls and drop his money off at remax . Took him almost a month to get me a new stove
 
If he is responsible for the past due bill from the tenants, and your power got shut off because of it, you might want to notify him. Im not sure of/if there can be any legal recourse but most states have some law protecting renters from landlord's actions that make a property "unliveable"
 
Almost 430 and still no power ... this time i call and they say the power was shut off at the pole due to an old meter and they thought my new smart meter would still work . Once again it dont make sence to me but i dont work for dte... they cant give me a time they can actually come out and fix it now either but once again they will be out today to fix it before close and this was from a supervisor
 
I think I would try to.....

1). Find out where these DTE people's office and or garage is (address).

2). Go there there & legally & peacefully petition / and or protest
out in front of their facility (without power, you don't have much
better to do). Bring a large sign & camp out on the sidewalk!

I'll bet they'll want you gone & they'll be back at your house before you!

Crazy as it maybe - tis an option.
 
11pm and im home from work. Still no power . DTE emergency line that i just called says someone was out today and they looked at my meter and that was it . Now another night with no lights and they cant send someone out because its dark and they have to hand a new line
 
It's the responsibility of your landlord to pay the bill for prior tenants. If DTE just turned on the power because someone said they were a new tenant would anyone ever pay their bill?

How many meter sockets are on the side of your place of residence?

If you think DTE is doing you a disservice you can call the Michigan Public Service Commission.
 
sounds like constructive eviction to me.
Call the landlord and tell him you are being constructively evicted from the house because the landlord hasn't paid the electric bill and you will be withholding pro-rata rent for these days.
IF he gives you shit, tell him to look up constructive eviction.


600.2918 Damages for forcible entry and detainer; damages for unlawful interference with possessory interest; exceptions; opening of probate estate; forcible entry or possession by occupant; action for possession; claim for injunctive relief; joinder; waiver; commencement of action; limitations; "owner" defined.

Sec. 2918.

(1) Any person who is ejected or put out of any lands or tenements in a forcible and unlawful manner, or being out is afterwards held and kept out, by force, is entitled to recover 3 times the amount of his or her actual damages or $200.00, whichever is greater, in addition to recovering possession.

(2) Any tenant in possession of premises whose possessory interest has been unlawfully interfered with by the owner is entitled to recover the amount of his or her actual damages or $200.00, whichever is greater, for each occurrence and, if possession has been lost, to recover possession. Subject to subsection (3), unlawful interference with a possessory interest includes 1 or more of the following:

(a) Use of force or threat of force.

(b) Removal, retention, or destruction of personal property of the possessor.

(c) Changing, altering, or adding to the locks or other security devices on the property without immediately providing keys or other unlocking devices to the person in possession.

(d) Boarding of the premises that prevents or deters entry.

(e) Removal of doors, windows, or locks.

(f) Causing, by action or omission, the termination or interruption of a service procured by the tenant or that the landlord is under an existing duty to furnish, which service is so essential that its termination or interruption would constitute constructive eviction, including heat, running water, hot water, electric, or gas service.

(g) Introduction of noise, odor, or other nuisance.

(3) An owner's actions do not unlawfully interfere with a possessory interest if any of the following apply:

(a) The owner acts pursuant to court order.

(b) The owner interferes temporarily with possession only as necessary to make needed repairs or inspection and only as provided by law.

(c) The owner believes in good faith that the tenant has abandoned the premises, and after diligent inquiry has reason to believe the tenant does not intend to return, and current rent is not paid.

(d) All of the following requirements are met:

(i) The owner informed the tenant in writing of the tenant's option to provide contact information for an authorized person the owner could contact in the event of the tenant's death. The owner is not responsible for incorrect contact information provided by the tenant or for the tenant's failure to provide contact information.

(ii) Current rent has not been paid.

(iii) The owner believes in good faith that the tenant has been deceased for at least 18 days and that there is not a surviving tenant.

(iv) After the requirements of subparagraph (iii) are met and not less than 10 days before the owner reenters to take possession of the premises and dispose of its contents, each of the following occurs:

(A) If the tenant provided contact information under subparagraph (i), the owner makes a reasonable attempt to contact the authorized person using the contact information provided and to request him or her to open a probate estate for the tenant within 28 days after the tenant's death. The owner is not responsible for the authorized person's failure to respond to the notification before the owner's reentry into the premises.

(B) The owner places on the door of the premises a notice indicating the owner's intent to reenter, take possession of the premises, and dispose of its contents after 10 days have elapsed.

(C) The owner notifies the public administrator for the county where the premises are located or, if none, the state public administrator that the owner believes that the tenant is deceased and intends to reenter to take possession of the premises and dispose of its contents if a probate estate is not opened. Upon request by the public administrator before the 10-day period under this subparagraph has elapsed and presentation to the owner of proper credentials and identification, the owner shall give the public administrator access to the premises.

(v) A probate estate has not been opened for the deceased tenant by the public administrator, authorized contact person, or any other person in the county in which the premises are located and the owner has not been notified in writing of the existence of a probate estate opened in another county and of the name and address of the personal representative.

(4) The opening of a probate estate by a public administrator under subsection (3) is at the sole discretion and shall be at the sole expense of the public administrator.

(5) An owner's actions do not unlawfully interfere with an occupant's possession of premises if the occupant took possession by means of a forcible entry, holds possession by force, or came into possession by trespass without color of title or other possessory interest.

(6) A person who has lost possession or whose possessory interest has been unlawfully interfered with may, if that person does not peacefully regain possession, bring an action for possession pursuant to section 5714(1)(f) or bring a claim for injunctive relief in the appropriate circuit court. A claim for damages pursuant to this section may be joined with the claims for possession and for injunctive relief or may be brought in a separate action.

(7) The provisions of this section may not be waived.

(8) An action to regain possession of the premises under this section shall be commenced within 90 days from the time the cause of action arises or becomes known to the plaintiff. An action for damages under this section shall be commenced within 1 year from the time the cause of action arises.

(9) As used in this section, "owner" means the owner, lessor, or licensor or an agent thereof.

Still no power ... once again i called DTE, this time there saying they dont shut power off at the pole that someone must have cut the line to steal it . This guy did say they are aware the line is cut and these been an order placed to fix it they just havent got to it yet . Going on 3 days no power
 
What's the landlord say? If it was my property I'd want power on to make sure sump pumps are running, etc.......... Let him make a phone call or two.

power is turned on , it was cut/disconnected at the pole .............. now im having an issue with a generator , ill start a new thread
