dealing with neighbors/landlords, how to handle....(rant)

Back in October I had part of a dead tree blow down, however it was help up by other dead wood. I was 99% sure that the root of this tree is not on my side of the line, so I called the city about it asking for input on what I can do. They said basically nothing because it is not my tree and not on my land. I understand that, so I let it be and was eventually going to write a letter to the owner of the house. The owner rents this house, he lives elsewhere.
Here is where the fun begins.
Monday I had posted about the tree blowing down in an “unknown” zone between houses.
The neighbor asked if I had a saw because the tree did in fact blow down onto his vehicle. I didn’t have a saw here at my place, but I also told him that he needs to call the landlord because I can’t do anything with the dead trees.
Landlord comes out with saw and guys to cut it up and get this piece off the cars. He says “I’m not pointing any fingers but I am not sure whos side its on”, to which I replied I can go get the survey, but I am confident it is not on my side.
He asked if I wanted any of the wood, I told him I could get rid of some of the wood for him. He commented that he was not going to take down the other 2 parts of the tree that have blown down toward my yard just yet. He was having a surveyor come out to assess the property lines and then see what happens is what I took from it.
So this morning they are out here again to take the other 2 pieces of the tree down and cut it up. This tree is fairly large and in a ditch/easement, they yank it out with the truck and cut it up, then pitch all the dead wood in the ditch and bail.
I am pretty disappointed that rather than having the guys drag it to the curb and then have the city chip it, they just make 3 big piles of wood at the property line, in the ditch and left it there.

WTF to do with it, it looks horrible, and with the already lack of drainage in this area, having a ton more of dead wood in the ditch is definitely not going to help with that.
I am thinking to call the city and see if they will in fact chip it if the wood is at the curb, the big stuff my friend will come and get for heating. If the city will chip it, I am going to call and see if the guy is done with the job and intends to leave it in the ditch, then I might nicely suggest to move it to the curb instead of leaving it in the ditch….See what he says.

I own my house, and this house is next door that is subdivided into rooms that he rents. Since he is not living here and doesn't have to see it, it is not an issue for him. He gets a check, and all is good....

You have home owners? Call them. I had something similar happen about 6 years ago. Except the tree was on my side. They guy called his, they in turn called the city. I had 2 choices. Remove it with a proper contractor or the city would remove it and charge me for the removal. I was lucky though since I was actually a rentor, so the landlord had to pay to have it removed. Not sure how legit all the back ally dealings were but, when a city truck pulls up and here are your choices, you have 48 hours to respond, what are you going to do. In all fairness the tree was going to kill someone if it ever fell.
 
If you're in a suburb, your city most likely has a city ordinance about firewood piles - distance off the ground (due to rats), etc. If they do, I would tell the city you want to report an ordinance violation & have them send someone out.

That said, I would give the landlord a few days since they downed the tree to get it taken care of. Maybe he has a 3rd party coming to get it all - who knows. If a week goes by and the wood is still there, I would be calling the city.

Sounds good...Although the way this guy works, and how the wood is laid out and scattered into the other woods that are there I dont think he has any plan of picking it up. I've got an email in to my friend at the city, and I will wait the week and then call the guy to see what he says, then go from there.

After I posted this, I went out to look around some more and there is a lot more stuff scattered through the area that the tree was. This is in a city, but not so much a suburb, it is a hidden area that is pretty low key, so not many rules or people around.

As for the fence, people have been saying that for a long time, but I am just against it...Today I was contemplating it after seeing this crap. I just dont want to build a wall around my place so I am in some sort of compound, but it would somewhat fix the problem.
 
1 - get your property staked by a surveyor. At a min get a metal detector and see if you can find the old stakes. I just found one of my stakes while clearing some brush. I had a deep 2 acre lot surveyed for $900. If you get one of your other neighbors to get their yard staked, they usually cut the price. When it's done drive some tornado fence posts. Into the ground or mark the property corners with big ass rocks.. done. No more debate.


2- i don't know a city that allows dumping in drainage ditches. Have city cite him. Make sure your yard is up to snuff though too.

3- i wouldnt wait. By the way you described it sounds like the guy is done. If there was effort put forth to scatter the remains of the tree, the landlord is calling the job done.

You could always clean it up yourself.
A rake, leaf blower, some compost bags, pile the wood out front & place a craigslist add or
Couple cases of beer, a few buddies (one with a old pick up truck) and a bonfire.
 
Sounds like you're on the right track. You live in a city, which most likely has ordinances about this kind of thing. Depending on what County you live in, the County Drain Comission may have a lot more to say about this than the City. I know in Monroe County, the Drain Comission has some torque.

How much trouble are you going to have to go thru to get the dang stuff cleaned up by the other party? Is it really worth it to make all these calls back n forth, talk to this person talk to that person, then end up having the owner prob end up pissy about the whole deal, then have to deal with him as well.

I'd just go pick the shit up myself and be done with it.
 
Good points here. I've learned to expect VERY little from people; that way, you're rarely disappointed. This landlord is just that-- trying to collect a check, and I'd venture to say that in the time, effort and energy you'll spend making this douche clean it up, you can do it yourself and make some friends at a bonfire.

My $0.02 FWIW.
 
I did end up calling the city and talking to the inspector division. He said he would go check it out, but by how I explain it that he will also be writing a letter to have it cleaned up.
I will believe it when I see it, but this time around he was much more attentive and listening to me about this situation.
My contact at the DPW also called me back and agreed, since he originally recommended to me get it cleaned up and it will help with the drainage issues. This dead wood being stacked in the ditch sure as hell isn’t doing anything for the drain problem….
Over the past few days, both of these guys have visited the house/s, so something has to happen, exactly what though I can’t say.

Go and clean it up myself sure, I could do that, again. I already did it once, I spent most of the spring last year cleaning dead wood, then I also disposed of it. It’s not just a few branches, it’s a ditch about 150’ long, full of dead wood. On top of that, all of the areas I did get into and clean out came up as nice places for them to dump all this stuff that was just cut up.

The guy is already pissy, the dead tree blew down on his tenants cars so he had to come out, that pissed him off. Yeah it sucks, and I have been doing a ton to clean up their crap, but this is over the edge, and out of the question for me to clean it up again after they were all just there to make these piles….
If you would like to come over and do it, I welcome you, and I’d even buy ya lunch for doing so. Let me know if you want the address…

sofa king I hope you're taking "before & after" photos of
this ditch area. It sounds like a real mess.

We recently had our Township clean up day. I brought down
a few bags of trash & 9 tires along my road that some folks had
dumped.

At first the township said they were only taking trash that day & NO
tires. Someone else in line saw the tires & offered to get rid of them
for me! I was gonna have to take them back with me if he hadn't.

It can be a pain sometimes trying to do the right thing.

Some high school kids kept parking at the end of our street smokin dope, I had to keep chasing them off.

The upside is that they keep making their bongs using parts of tools. The last 1 had a 13 millimeter socket for the bowl... it was a craftsman socket guaranteed for life. A small upside to a nuisance.

I think the only positive here is that this thing would somehow catch on fire, and then take out my house & stuff with it...
Of course when I am not home, then I can just drive by and go elsewhere...Kind of like office space...
 
Just an update....
About 2 weeks after the whole cutting of the tree crap went down the guy was out there again with the same who cut the tree up and dumped it.
They went through this whole wooded area and chipped all the stuff, as the inspector said he would give them that option, else after 14 days he would be cited for dumping and whatever else inspector can think of since the owner of this property is not so considerate or cooperative.
It looks better for sure, unfortunately though the big piles of woodchips are not as nasty looking or ridiculous as the trees laying all over the place...
