CDL & Alchohol question

I don't have a CDL but somebody told me if you have a CDL your BAC content when driving drops from .08 to .02 even if you are driving a normal car/vehicle. So, if you are out to dinner on a Saturday night and have a beer you now have a .02 limit instead of the .08.

Anybody know if that's true?
 
.04 is what my wife always told me it was.... (She had a CDLP) I gather she learned that in classes she took all the time.
I guess your held to a higher standard.
 
If you have a cdl and get caught driving a personal above the limit, you will still lose your cdl. That's my 0.02 cents added to this post.

Once you have a cdl, driving anything it's still the same limit. Which is complete bullshit.

You will be immediately placed out-of-service for 24 hours if you:

Refuse to take a preliminary breath test (PBT)
Consume alcohol within four hours prior to operating a CMV
Consume alcohol while operating a CMV
Have a bodily alcohol content (BAC) of .015 grams or more per 100 milliliters of blood, per 210 liters of breath, or per 67 milliliters of urine

Just can't drive within 24 hours.

Other Alcohol Violations

If you have consume too much alcohol and operate a commercial motor vehicle, you can be charged with:

Operating with an unlawful bodily alcohol level (UBAL) of .10 grams or more per 100 milliliters of blood, per 210 liters of breath, or per 67 milliliters of urine
Operating under the influence of liquor (OUIL)
Operating while impaired (OWI) when your BAC is more than .07 but less than .10 grams per 100
milliliters of blood, per 210 liters of breath, or per 67 milliliters of urine
Operating with a BAC of .04 - .07 grams per 100 milliliters of blood, per 210 liters of breath, or per 67 milliliters of urine
OUIL, OWI or UBAL causing death or serious injury


It says directly that if you consume and operate a commercial motor vehicle, not if you're operating your personal vehicle.
 
I promise if you get a dui, owi, or any variation of it while operating your own personal vehicle, you will lose your cdl. You will need to reapply after whatever your sentence is.
 
Trust me i have my cdl. Its .04 at any time other then on the job its .02. you are held to a higher standard. If u get a dui or any drinkin ticket you lose your cdl 1 year and a 2nd could be for life.

I'm assuming your reply was not to me? I've held my cdl for nearly a decade AND unfortunately went through the court process. After a long court battle and trying to discredit the pig, I mean cop. Without making it a story, it was my first real taste of how corrupt the legal system is. Me, my Lawyer, and the judge were in the judges chamber I was asked how much money I would like to pay for this to go away. Literally wiped from all record. That's fucked up!! I won't get into it anymore. But I have zero respect for anyone in our justice system anymore.

Once again to the OP. If you decide to get your cdl DO NOT drink even 1 drink if you think you will be driving anything in a short time. If for whatever reason you find yourself dealing with the cops they can burn you at their discretion.

yet we have to spend countless time money and effort to convict someone caught redhanded peddling drugs or beating someone near death?
 
I still don't see where it says when driving something other than a commercial motor vehicle in there at all.

My two cents is to use Lyft/Uber if you're even having one.
 
Mouthwash or even a night of celebration that didn't fully dissipate in 6 hours of sleep would not be tolerated with how I'd understand that. Crack passes a bac test though.

company policy is zero tolerance for alcohol if I get busted I loose my job even if I'm driving my
own car ...
 
When they send for random the typically always do the piss test and the BAC is the bonus. My employer has the right to send you for probably cause. It's a shame that its just us cdl drivers that get randomed at work and not all other working classifications.
