update from the first post:
We ended up getting the restocking fee back, though they said it would take 6 weeks or so to get it. It took a few phone calls and the AT&T store blaming Apple, then Apple giving us AT&T's headquarter's phone number to call, then everything worked out.

I'm using the 3G 16GB phone with T-Mobile and since T-Mobile's 3G is a different frequency I have it shut off. Probably why I'm not running into the problems that you guys are.
