21 mile and fairchild off-road trails?

If you see a car parked along the side of the road in front of someones house does it mean it is free? Or if you see "lets say" a stack of fresh cut firewood on someones yard does that mean you can just take what you need? Hate to see you go riding there with the owner NOT knowing and then you get hurt and then try and sue!:rolleyes:

You have to prove intent to trespass and interference with the owner's intended use and a refusal to leave upon the owners request.
 
Oh, and if anybody feels like tearin' that up this weekend, I'm down. I'd like to see what the FX4 Ranger is capable of, even with worn out stock tires....

the cop told me unless you have written permission to be on that property its considered trespassing... i went to court on it the first time and it was put under advisement for a year and then about a week after the year ended i got hit again...i used to ride there almost everyday, when i bought my banshee from macomb powersports i went across the street and rode it there 2mins after i bought it...
 
Looks fun. Maybe find out who the owner is, and make up a contract waiving responsibility? Never know, might work.

i heard he wont do it, he said even if he has a waiver he will still have to shell out money for a lawyer if somebody does decide to sue him so he wasnt going too...but this was a few years ago when i used to go there all the time...
 
The chesterfield police are not very friendly about offroading. They used to just kick you out back in the day, but they ticket/tow now.

324.73102 Entering or remaining on property of another; consent; exceptions.

Sec. 73102.

(1) Except as provided in subsection (4), a person shall not enter or remain upon the property of another person, other than farm property or a wooded area connected to farm property, to engage in any recreational activity or trapping on that property without the consent of the owner or his or her lessee or agent, if either of the following circumstances exists:

(a) The property is fenced or enclosed and is maintained in such a manner as to exclude intruders.

(b) The property is posted in a conspicuous manner against entry. The minimum letter height on the posting signs shall be 1 inch. Each posting sign shall be not less than 50 square inches, and the signs shall be spaced to enable a person to observe not less than 1 sign at any point of entry upon the property.

Forgive me if I'm wrong but the law you posted, from what I took from it was talking about farm land. The property at 21 and fairchild is connected to DTE transformers and industrial property. Not a flame here just a question. :)

You are wrong. It's says "Other than farm property"

Not a flame, just an answer to your question.
