unemployment questions, part II, received notice to appear before a judge

In an nutshell, my wife was permanently laid off from her job back in April. And ever from the start, she has had nothing but problems dealing with the Michigan unemployment agency. 2 main problems were that they said they were not supposed to pay her for 2 weeks because her severance was 2 weeks pay. The thing about that is, she turned over all her stubs and info regarding her job loss and they never raised any flags or said anything then, but 3 weeks later they sent her a letter saying she fraudulently collect for those two weeks and they would withhold money from future payments until it was paid back.

Then they send her a letter saying she fraudulently collect her first weeks pay because she was not going to work that week anyway. This is in reference to her having a scheduled dr. appointment on a Monday (she was let go the next day). They are trying to say that due to her missing work that Monday for a Dr's appointment, that she was not going to work the rest of that week, therefor she should not have sought pay for it. This obviously was not the case at all, she even got a letter from the Dr where she had the appointment stating she was only in for a procedure and was able to return to work the following day. My wife spent over 15 minutes on the phone with someone from the agency trying to explain over and over again that she was willing and able to work that week, the lady ended up calling my wife ignorant and hanging up on her.

Now today she got a letter from state of michigan that says she must appear before an administrative judge in Detroit on July 2nd to determine if she will lose benefits, be fined, and or charged with fraud, Her and I are so upset over this shit right now we dont know what to do or expect. Were worried this hearing will be totally one sided and she will ended up screwed over. Any input?

I divorced Marvin about 3 years ago, but based on my recollection:

1) If you received a lump sum severance payment after separating from the company, then you simply reported it at that next bi-weekly report into MARVIN & you don't collect your normal UIA payment for that 2 week period. It doesn't matter if the severance payment was for 2 weeks, 2 month or 2 years of pay... you just skip that 2 week cycle of UAI pay.

2) Not sure I totally follow, but you're saying that she worked on a Monday, let go on Tuesday... but then she claimed the entire week as being laid off? If so, I honestly would have waited to til the following week to be "week 1" of UIA comp time.

I thought it was based on hours worked that week. If I remember right people could claim a partial week when they didn't work everyday.
 
By law she is entitled to a free lawyer paid for by the state for these hearings... Get one and show them everything

And where/how does the acquire one? I did not see anything in the letter about them providing one for her. It just says you have the right to be represented.
 
You can talk to Mark (wicked svt). He gave me the name of a lawyer that specializes in unemployment stuff. Worked for my fiance as she finally won her unemployment pay. They had been fighting her since she got let go back in April. It finally went in front of a judge and they made a decision.
 
The thing is we have no money for an attorney...its hard enough as it is.


You dont need an attorney, she can go in front of the hearing officer without one. If she is telling the truth and explains what happened, she should be fine.
 
This same exact thing happened to me. I commented on your original post about it. It took 6 months for them to send me a notice that i was payed when i shouldnt have been. The problem that upset me so much is before I collected a dime i had to send them a letter explaining exactly what my severance was. If I wasnt entitled to the money why did you pay it in the first place lol. Looking back I should have taken it to court. My mom went for a similar issue and she took it to court and they basically said she was in the right and there were no issues. Good luck I think you should be fine.
