Question on family transfer of a firearm

I am coming home in a few weeks for vacation and my dad is giving me his 357 handgun. How do I go about this in getting the handgun home. Can I just take it with me and check it on the plane or do I need to get some kind of paperwork. I am bringing it back to arizona

What if the individual resides within the same State?
Under Federal law, an unlicensed individual is prohibited from transferring a firearm to an
individual who does not reside in the State where the transferee resides. Generally, for a person
to lawfully transfer a firearm to an unlicensed person who resides out of State, the firearm must
be shipped to a Federal Firearms Licensee (FFL) within the recipient’s State of residence. He or
she may then receive the firearm from the FFL upon completion of an ATF Form 4473 and a
NICS background check. More information can be obtained on the ATF website at www.atf.gov
and http://www.atf.gov/firearms/faq/unlicensed-persons.html. The GCA provides an exception
from this prohibition for temporary loans or rentals of firearms for lawful sporting purposes. For
example, a friend visiting you may borrow a firearm from you to go hunting. Another exception
is provided for transfers of firearms to nonresidents to carry out a lawful bequest or acquisition
by intestate succession. This exception would authorize the transfer of a firearm to a nonresident
who inherits a firearm under a will or by State law upon death of the owner. See 18 U.S.C. §
922(a)(5)(A).
In regard to transferring firearms between individuals residing in the same state, any person may
sell a firearm to an unlicensed resident of the State where he resides as long as he or she does not
know or have reasonable cause to believe the person is prohibited from receiving or possessing
firearms under Federal law. Please note that there may be State and local laws that regulate
firearm transactions. Any person considering acquiring or transferring a firearm should contact
his or her State Attorney General’s Office to inquire about the laws and possible State or local

I don't know the rules in AZ meaning are you yourself legally able to own a hand gun in AZ, but when a hand gun transfers ownership between 2 parties in different states it needs to go through an FFL at least on the receiving end. The receiving FFL may require that it be shipped from another FFL and they would exchange copies of their license via email/fax.... The ATF rules say that if your father were to ship it directly to an FFL in another state he would need to at least get a copy of the license from the FFL he is shipping it to. I think if the gun owner, your father, were to transport it to AZ the two of you could go to an FFL in AZ and do the transfer on the spot, you can do this in a resident of another state were selling a handgun to a resident in Michigan.

It is confusing but bottom line it needs to go through an FFL in the state of it's new home and it is at the discretion of the receiving FFL if they will take from a private individual without an FFL.

I would call the ATF in your state.
 
Awesome info, I will check with my local FFL and see how they would like the transfer. Then the ATF if needed. It shouldn't be a problem on my end out here in AZ, just want it to be easy for my Dad.
 
Your dad will have to ship the gun to your ffl in AZ. (He will likely have to use an FFL of this own to do this due to USPS not shipping handguns and Fedex and UPS will only accept hand guns at certain locations usually the distribution terminals if you are not an FFL). Once your FFL receives the gun he will log it, You will fill out the 4473, FFL runs background check and you walk out with gun.
