Open alcohol in public question

I was at woodward today, in a lot a company rents and i get a pass from them to park and they serve food/drinks (open bar). in front of the building and parking lot is lined with cars, which i was walking down checking out the cars when an officer approached me and my girlfriend, which came off having a smart ass attitude from the get go, and long story short, wrote both of us tickets for open alcohol in public. I assumed we were doing no wrong as we were surrounded by dozens of people consuming drinks from the same cups as us sitting under their canopies and walking checking out the cars. i understand if i was in some random area slammin some brew, but i was right in front of the place serving it, which the officer knew they were serving because he asked to see my pass from there.

This was in Royal oak, i figured the guy would just give us a warning and tell us to stay back in the lot or something but he wrote us both tickets, and it's a damn misdemeanor! I don't know how serious this is, as i have never been in trouble with the law, and i have a perfect driving record.

Just looking for advice or suggestions on how to handle this. thanks motown
 
Sadly there's not much you can do other than take it to court and try to reason with the judges but you they're definitely cracking down.
 
I'm curious what the fine is, the cop said i might just be able to pay the fine and not have to go to court. some of the things i read online people say it's only about a hundred bucks, then i read people say to get a lawyer and expect to pay 750-900 dollars in fines and court costs
 
this happened at the motown lot farther north a few years ago. wkdsvt even confronted the police about it but could do nothing
 
I avoid WW like the plague during cruise weekend. Too many things and people only there to purposely ruin your day.
 
I got a parking ticket near Mustang Alley. I was parked on the corner of 9/ Paxton. Cop wrote me for parking in a prohibited location. Whatever- They just want $35.00 from me.

I got one in downtown royal oak earlier this year. I hired a lawyer and got it knocked down to an impeding traffic. Fine for the ticket with the misdemeanor is $175. The impeding traffic was $500 and then lawyer fees on top of that.

Send me a PM if you want the lawyer I used, but since you have a clean record it shouldn't be tough for any lawyer to get it knocked down.
 
I know a friend of a friend of a friend of a friend wink wink who had one of these from the cruise. go to court with the 3000 other people who got one at the cruise and you'll walk out a couple hundred lighter and an impeding traffic charge.

you won't even go in front of the judge/magistrate, walk in a room they'll say u want impeding traffic? nod smile sign and pay the lady
 
what proof does the officer have that you had alcohol? He has the burden of proof.
Did they confiscate the cup? it's content?

the "smell" test does not hold up in court.

Unless of course you admitted to it being alcohol and he recorded it.

Hmmm, sounds like your friend of a friend was in the bed of a truck of guy I know through another guy. Good thing that guy that I know through another guy was smart enough to set his beer down and walk away...... :)
