Ebay Auto Part Shipped Broken….Help!

Well it has only been my 4th or 5th item I purchased from Ebay
and I already hit my first problem. I knew I shouldn’t have purchased
from a “94.5%” guy – but I did. The part was cheap enough, part $10.50
and shipping $15.00.

The problem is, the part showed up today with one end of the box wet & soft
like it had been dropped or had one end of the box crushed. The packaging was
good on the top & bottom, but there was NOTHING on the ends of the box
& the plastic edges were packed tight to the cardboard – meaning no protection.
Both ends of the plastic trim piece were broke (one piece still in the box, one gone.)

If the seller would have packed it correctly, the plastic trim piece would have been fine.
If FED EX would have not “dropped it in a puddle” the plastic trim piece would have been fine.

The shipping cost more than the part. I might be able to combine the broken part
& my old part – But I don’t think I should have to pay for this broken one.

I paid for this with paypal. If I dispute this with paypal will I have to return the broken part? How does this work? What would or have you guys done in such a deal?

Contact the seller and see if he will make good on it, if not open a dispute and you will get your money back.

I don't know about FedEx but UPS automatically insures package contents for $100. Contact the seller and see if there's any insurance on it. If it was the fault of FedEx maybe you can get your money back from FedEx without having to return the item.

Fragile stuff should be packed properly. Tell him his rep is going to drop due to his lazy cheap packaging.

Since the part is relatively inexpensive you can hit him hardest by leaving negative feedback. I'm pretty sure paypal is going to ask you to return the part if they rule in your favor.

I don't even think you can leave negative feedback on ebay anymore, can you? I think last time I had tried that and it was not an option.
Sucks though, but check with the seller, tell him to refund you and he can deal with fedex....

He already left me a "positive feed back", if I leave him a negative, can he then change mine?
I paid immediately - as I always do.

Sellers can only leave positive feedback.

Dennis

Exactly, as a buyer your only obligation is to pay for the item so ebay only gives the seller the option to leave positive feedback. However, the sellers obligations are much more in depth and a buyer can leave negative or positve feedback for the seller. They did this to prevent retaliation feedback in the event where a buyer left negative feedback for a seller and in turn the seller would do the same for the buyer.

No he cannot change feedback he left you. The only way your feedback can be altered is if you put personal or insulting information in there and he notifies ebay.

I had a situation where a guy tried to screw me over on a part I bought from him. He completely lied about the actual condition of the part. I tried to work it out with him but he decided to be a tough guy and tell me to basically go F myself. Since I was in MI and he was in Indiana, He figured that he had me over a barrel. It turned out that my best recourse was to basically tell my story about this on a bunch of websites that I knew he frequented. It turns out that this wasn't the first time he had done this to someone. A bunch of other people came out of the woodwork with similar stories about him. I eventually got my money back from him and an apology- as well as alot of other people. Not saying this guy is going to do the same thing to you, but if he does, maybe that route will work for you too. Good luck.

The letter I just sent the Ebay seller....

"Dear Mr. Xxxxx,

I just received the “2007 08 Mercury Grand Marquis Truck Panel Tail Light”.

I purchased this item from you on Ebay and paid for it ($10.50 for the item and

$15.00 for shipping) with Paypal.

As evident by the enclosed photos this auto part was not packaged properly,

a plastic part that is 50” long & weights 4 lbs with pointed ends, should have

been packed with protection on the ENDS of the box as well as the top & bottom,

(that you did pack well) but not securing the box ends was negligent.

Furthermore, you packed the plastic part with the pointed end tips pressed tight

against the shipping box ends. I see this was a box that you cut down to fit the

part, so you had to have noticed the narrowest, thinnest most fragile part of the

item was now resting directly on the thin unprotected cardboard box wall.

The resulting poor packing of this auto part has this part damaged on both ends.

Please advise me as to what options you offer me on this diminished value,

now damaged auto part.

Thank you,"

*** Update ***

After I sent the above letter to the seller,
he sent me the following message:

"You are right. I will refund your money"

So hopefully he will come through & do so. If he
does, he'll then earn himself a +positive rating.

I'll let you know how it turns out.

Hopefully you get your money back from the guy. I was looking at his negative feedback comments and it sounds like he screws a lot of people. BTW...10.50 + shipping is DIRT cheap. Those panels list out around 379 at the dealer.

Dear Mr. Xxxx,

It has been three days since you stated you would send me my auction refund.
I made my payment to you immediately following the auction. Please respond
promptly.

If I don’t receive my refund within the next 48 hours, I will pursue other options.

Thank you,

^^^^ Got refund within 1 hour of sending this ^^^

I left him positive feedback with this note…..” Incurred problem, Seller refund / fix, Buyer happy.”
