People will blame you for a car accident even if it is their fault! This stupid old bitch hit me a couple hours ago as I was turning into a parking lot. Scratched the hell out of my wheel, dented and scratched my rear quarter panel and rear bumper. I was turning left into the driveway which is an entrance/exit. As I was turning left into the entrance, this old bitch was going 5-10mph headed towards the exit with more than half of her piece of shit in the entrance portion of the driveway and clipped the back of my car. So not to block the whole driveway I pulled into the nearest spot. I get out of my car and she rolls her window down and starts screaming that I HIT HER! I kept my cool somehow, probably because I have enough respect not to scream and argue with a lady that has to be about 119 years old. I tried getting her info but she was too busy telling me I was wrong. So she called the cops, pointless because its private property. So he comes, we exchange info. After the cop leaves she calls me over to her car while I was taking pics of the damage, and says that she wants to settle this without involving the insurance company, which I agree. But she says that I just need to get some quotes, contact her, and she'll take care of me. So I just got back from filing a police report and cant get ahold of the driving dinosaur. I'm still fucking pissed. I am going to get a quote from the dealership, but where else should I get a quote from? This car looked brand new and thats the way I want it back. :image_013:893Rant-S
 
Just make a claim with her insurance if it was her fault it will all be taken care of, take it where ever you want get rental as long as you need, no deductible.
 
At least you didn't try to play it off like you didn't just get hit by a car!!!

wrong private property his insurance covers his car he will have a deduct there was no fault assigned

I would make the claim and have it done right unless she gives you the money order or some type of funds out side of a check
 
Alright so now I'm just confused. I was reading that if I report it to my insurance, I will have to pay the deductible, and because my car was moving, not parked, that all I can do is sue her for $500 tops according to the Mini-tort law to basically cover the cost of my collision deductible. Is this correct? Someone please enlighten me.
 
yea just make a claim... you have the incident report and her name... let your ins. take care of it... same shit happened to me this summer.. you should not have a deductible or get increased rates. any pics of the damage??

It was/is dark so I cant take pics, or really even see all of what's damaged. Tomorrow will tell. She couldnt have been going more than 10mph if I had to guess. But it was enough to bump out the back of my car, scratched up my wheel pretty bad, I can see scratches on the bumper, appears to be dented, and the gap between the trunk and the quarter panel is bigger on the side that was hit compared to the passenger side. There's obviously full coverage insurance on the car. I have basic collision rather than broad though. If I'm not mistaken dont I pay the deductible regardless with basic collision? Thanks!

I didnt catch no fault assigned earlier. Best way to do it is the Mini-tort, work with your agent on that one. is you have standard collision you will pay your ded and wait for the mini-tort to reimburse you.
