Character Reference Letter

So I have a buddy that is getting the book thrown at him over a dispute, he got screwed over on some firewood and now it is his word over two guys that split and deliver firewood for cash. It isn't a reputable business, just two guys working for cash. My buddy had his gun with him and no shots are fired and no brandishing was done, basically the guys showed up at his house because he stopped payment on the check and they wanted him to pay but my buddy wanted them to take their crappy wood back. The two guys in the truck called the police and said he was holding them hostage at gun point and the judge wants to charge him with a felony since he was carrying a gun, first offense for anything and other than a speeding ticket. So I wrote up a character reference letter to try and help him out since all he can afford is a court appointed attorney. I change the name to Dan and left the last name out so it would be not so obvious, he isn't a member here lol

I am writing in reference to Dan pertaining to an incident that recently took place.

I have known Dan for over 20 years, and we are alumni from the same small town school, team mates throughout the years playing sports, growing up in the same cub and boy scout troops in addition to have knowing each other and each other’s families for quite some time. I believe I am in a position to speak to Dan’s moral character, so I hope you will take this letter into account when making your decision.

In the years that I have know Dan I have never seen him act viciously or aggressively towards anyone. He was always willing to participate with any groups and he would be reasonable in any decision making process. He never disliked anybody and would never single out or bully any select person or group. Dan was never in trouble in school and was one good all around student. He has worked hard over the years and I believe he would continue to do so.

It is a challenge to make the right call with the information that is given to you from something that happened one day. I hope this letter does help you get to know the person who is in your courtroom on this one day you are deciding what punishment will fit Dan for the crime he is in front of you for.

Open carry, and that is what sucks, two guys versus just him. If the two guys keep the same story it would appear to be truthful. I just hope my buddy isn't pulling my leg and I am trying to help him get out of the sh!t he got himself into. I don't think he would lie to me about something like that.

Gotcha. That sucks. It seems like a stretch to prove anything happened. Has he been convicted and is just waiting on sentencing?
 
Nope, his court appointed attorney got him to plea bargain and to get him to ask for letters of reference so the judge would consider just giving him probation versus a felony of 1-5years. I guess if the judge takes the letters into consideration it shows that he just made a bad decision versus being a bad person. I told him to plead not guilty and make the prosecutor prove you are a bad person.
 
No offense, but you're doing your buddy no good by posting the letter and situation in a public forum. Then a few posts later saying you hope your buddy isn't pulling your leg.

I'm no lawyer, but you should reconsider your statements before blasting them online
 
If he didn't do anything why accept any plea? I wouldn't want any charges showing on my record. I would go to trial if need be.

You're right innocent people are never found guilty. :) He can't afford a good lawyer, if he loses he could face prison time, you do what keeps you out of prison especially if you have a family to support and you're no longer a young man. I personally wouldn't take the risk if the deck was stacked against me like it sounds in this case. Of course I'd never find my self in this situation, I never buy firewood since it's near impossible to find usable firewood without doing it yourself. ;)

Did he let the 2 men into his home or did all of this happen outside?
It was outside.

I didn't say he was a liar but I did say he isn't the kind of person to lie about something like this. He has already entered the plea, the sentencing hearing is very close. In fact the case could already be closed on this if it is fact real.
