Make you get back in your vehicle and issue you a ticket for an infraction that occurred way before you reached your destination?


I was ordered to return to my vehicle and be issued a improper passing ticket. I went around a few cars at an intersection a half mile back and . I was starting to unload some stuff from my truck. When the officer pulled up demanding that I get back in my vehicle.

I plan on fighting the ticket just wanted to know if an officer can make you get in your vehicle and issue a ticket if a person already arrived at their destination, was out of the vehicle, and the infraction to place in a different area.
 
Sounds like your already admitting guilt... no need to waste the courts time... The cop caught up to you and gave you a citation.
 
Same thing happened to my uncle this past summer. Did a big ass burnout in front of his house and got out of the car just as the cop pulled up. Guess it was just easier and a lot cheaper to pay the ticket.

I agree to an extent.

It doesn't matter if you "beat" the cop to your destination. Are you guilty, yep but you should fight it. When I was young and dumb(now old and not as dumb) I would fight all my tickets that were bigger than 5 over type tickets. I had a lawyer that managed to get a bunch of tickets lowered for me. Fighting on your own is probably a waste of time but if you lawyer up you may have good results limiting the long term damage.(insurance, points etc)

One time I ran from the police across 2 states topping 120mph, I beat them to my house and just jumped out of my car and said "I win!"
 
Just set up a informal hearing and explain it to the judge what happened but most Likely u are guilty and it will be up to the judge and maybe plea it down to a impeding traffic where it's just a fine and no points. What county did it happen in?
 
If you can get a ticket for drunk driving, while sleeping it off in your car with the keys are in the ignition......

you can get a ticket in your driveway.
 
If I were you, I would plead guilty no contest. Worst case it's 3 points which sucks, but depending on your driving record the just may drop it down to a fine only. You didn;t mention where the ticket was issued. I hope for the best for you and maybe the cop won't show up on the court date.
 
Lawyer, lawyer, lawyer. Get a lawyer.

You might have to throw some money at it, but I'm sure a lawyer can get it reduced.
 
They ticketed me about 5 miles and two schools away from where the cop said he tagged me for speeding.

Cop asked me how fast I was going when I passed "that school" to which I told him 40mph (which was the speed limit of the school I had JUST passed)...

He said the speed limit was only 25... (which it was, 4.5 miles up the road from where the OTHER school I passed was...)

I asked him, wait, which school are you talking about and he said "THE school...." (really vague)


Anyways, I told him there was no way I was doing 40 there as I was going with the flow of traffic which sped up after that point to the 40mph limit we were in.

He ticketed me and I fought it. She said I admitted to doing 40 even though his description was vague....but "gave me a break" by dropping the fine and but sticking me with the points.
 
I don't give a shit if I've been caught red handed I always go and make a attempt to lower or reduce points. Take it to court admit guilty with reason, the magistrate will most likely reduce your charges just for taking responsibility.
 
You will be in front of a magistrate not a judge so dint waste money on a lawyer, it will just be you and the cop talking to the magistrate. After he hears the cops side and yours he will decide to reduce or keep the same charges. I've been infint of the guy in port huron 7-8 times and only once he kept the charges filed. These are from careless driving, to speeding at a 88mph in a 50mph.
 
Ya u need to take it to court , at least try it, worst case it cost u a few bucks more for court cost, but if u have a good record, a lot of times they will drop it to impeading traffic which is no points, and your are just assessed fines for original ticket. They just want the money. And yes he can make u get back into your vehicle if the issue he's stopping u about is in regards to the vehicle u were just operating. What city??
 
For a civil infraction, the police officer must PERSONALLY witness the violation.

For a misdemeanor or felony, the Police can rely on witness and do not have to personally witness the violation.
 
back in high school a friend and I were fucking around on rochester rd, racing eachother and probably doing about 80. saw a cop and we high tailed it into a murrays about a mile away. he hung out in the lot for like 30 minutes waiting, so we had another buddy come pick us up and we came and got the cars the next day, totally lucked out
