He should have the book thrown at him. First off, he was drunk driving, a definate no-no. Second, and worse in my opinion, he was passing on a double yellow while he was drunk. He doesn't deserve to see the light of day for a very long time. I hope it is at least as bad as here, 15 years.

I don't think it's any worse to kill a cop. I think they should charge death of teachers worse than the death of police. But cops get treated special because they work hand in hand with judges, etc.
 
I don't think 15 years is enough honestly.

Al, I agee that he should be made an example. I wasn't suggesting they should let him go cuz the damage is done.

Oh, I'm pretty sure he'll do time. He's not that big of a celeb. We all know who he is cuz we're car guys. I'd say 80% of people I know don't know who he is.

My friend he has a much greater following then just some car guys from michigan. That guy is the spolight at EVERY BIKER RALLY AROUND THE FUCKING WORLD.

......It doesn't help that he killed another biker though

There is alternate punishment path that is being chosen by the DA in this case. He is setting up the follow on civil case for wrongful death.

The current charges are an easy no fuss guilty verdict. This plays into the civil trial where the judge and jury both know that he is guilty and he got off easy. The payout for pain and suffering could be big depending on what the Florida limits are.

I think you are right. Wrongful death case is gonna be huge. I will say that money can't replace a life though. If I had the choice of 100 million or my Dad not getting hit on his bike. I'd rather be poor.

Yeah but if the charge isn't correct the jury will more likely to return a not guilty verdict
Voluntary manslaughter is commonly defined as an intentional killing in which the offender had no prior intent to kill

If you changed it to Murder you have to prove that he know that guys was going to be on the road at that spot and he planned on swerving and killing him, the fact that he was drunk makes it less likely.

Not true Just remember Officer Gary Davis Killed in the line of Duty by a Drunk driver who was found innocent and is now suing the city for his pain and suffering.

The problem is, it wasn't premediated. Your definition on premeditated is flawed. If you want him to get more of a punishment he would have had to go to the bar, with the purpose of getting drunk to kill THIS man... Get drunk, while maintaining the goal of being drunk to run the man over... Get in his truck, FIND the guy, while still maintaining his plan of killing him.. THEN running him over..




It was an accident - manslaughter is the crime.
