Am I screwed?

Car (99 Grand Am) hit the ditch, passengers side mirror trashed and water damage to passenger's side carpet. Other than that, it isn' dented or any other damage. BUT, when the dude pulled the car out, he didn't put the trans in neutral and straighten out the front wheels. Now he latched onto the rear axle and damaged it and the rear bumper. Driver told us they would pay to fix it. I have pics of everything before and after he pulled the car out. NOW they don't want to pay. Are they legally responsible for the damage they did?

F yeah they are.
So long as you have those pictures.

Develop them and make copies, they are your life blood right now.
You are going to have a fight ahead of you but they are liable for damage to your car while hooked to there rig.
